These regulations specify the rules and conditions of use of the online store: HOMEprint.pl (hereinafter referred to as the store), operated by HOMEprint Sp. z o. o., based in Będzin (42-500), ul. Stanisława Małachowskiego 27, NIP: 644-353-11-65, hereinafter referred to as the "Seller".
The Customer, hereinafter referred to as the "Buyer", is obliged to use the store in a lawful manner, taking into account the respect for personal rights, intellectual property rights of third parties and good customs.
HOMEprint sells in European countries and around the world where the store's website is available.
The buyer is obliged to read the store regulations, and ignorance does not exempt him from the provisions contained therein.
Orders:
The buyer places an order via the online product configuration and order processing system prepared by HOMEprint, available online. The Seller also provides for the possibility of placing orders via e-mail at biuro@homeprint.pl or by phone at +48 796 122 633.
Each time, the condition for placing an order is the Customer's approval of the final version of the product presented by the Seller, confirmation of acceptance of the order by the store and payment by the Buyer of the order using available payment methods.
The Customer may place Orders online via the store 7 days a week, 24 hours a day, provided that their execution will begin after meeting the conditions specified in point 2, on the next business day.
Orders are accepted in the order they are received.
The average order processing time (from the moment the payment is recorded until the shipment is sent to the indicated address) is 5 business days (except for glass panels).
The Seller reserves the right to refuse to process an order that does not contain the data necessary to prepare it and orders that have not been paid within 7 calendar days, unless individual arrangements between the Parties provide otherwise.
Payment:
Each time, the condition for acceptance of an order is to make a payment in the form of prepayment to the provided account or via available online payments, in the amount specified in the order.
Payment is considered completed once the payment is credited to your account.
All prices given by the Seller are expressed in Polish currency and are gross prices. The prices of goods not covered by the "free delivery" promotion do not include delivery costs.
The Seller reserves the right to change product prices without giving a reason.
Delivery:
Delivery takes place to the address indicated by the Buyer when placing the order.
The HOMEprint team makes every effort to ensure that the delivery is completed as soon as possible from the moment of shipment - however, it is not responsible for any delays caused by the courier company.
The seller specifies a catalog of products covered by the "free delivery" promotion. Information about the fact that the promotion is covered is always included in the product description.
The "free delivery" promotion exempts the Buyer from the costs of delivering the shipment, except for the situation described in points 7-8.
Shipping costs for products not covered by the "free delivery" promotion are charged each time you place an order in the creator, in accordance with current price lists and depend on the weight and size of the shipment.
The delivery costs of products not covered by the "free delivery" promotion are borne by the Buyer.
If the Buyer fails to collect the goods sent by the Seller, the Buyer will be charged with the costs of returning the undelivered shipment.
The Seller is not liable for failure to deliver the goods for reasons attributable to the Buyer - including: due to providing an incorrect delivery address. In such a situation, the Seller, at the Buyer's request, will enable the goods to be collected at another place or date. The cost of re-delivering the goods is covered by the Buyer.
In the event of the delivery of goods not complying with the provisions of the contract and resulting from the fault of the Seller, the Buyer undertakes to provide an additional deadline for order completion of no less than 2 weeks.
When receiving the parcel from the courier, the Buyer should check whether it is not damaged. If the shipment shows signs of opening or visible defects, the Buyer should not confirm receipt and prepare a damage report, which will be the basis for filing a complaint, and inform the Seller about an attempt to deliver a defective shipment. If damage is found after confirmation of receipt, the complaint will not be accepted.
In the case of delivery of glass panels, the Buyer is obliged to unpack the shipment in front of the courier and check for any damage.
Complaint procedure and withdrawal from the contract:
The Seller provides a 24-month warranty, starting on the day the Buyer receives the ordered goods.
The customer is obliged to notify the seller about the detected non-compliance of the goods with the contract within 7 days from the date of finding the non-compliance.
Differences in the reproduction of colors and patterns resulting from individual monitor settings or other minor technical deviations related to the production process cannot be the basis for a complaint.
Files for printing should be prepared by the Buyer in accordance with the technical specifications applicable to individual products. HOMEprint is not responsible for the quality and content of photos sent to complete the order. A printout that does not meet the Buyer's expectations due to poor file quality cannot be the reason for a complaint.
Defects resulting from incorrect actions of the Buyer during installation or use of the product cannot be the basis for filing a complaint.
Proof of purchase and packaging containing all additional equipment included in the order are necessary in the complaint processing process.
The products offered by the Seller are manufactured from scratch exclusively at the request of the Buyer, who each time specifies the order parameters: photo, type of material, print dimensions and any additional options. The buyer accepts the final appearance of the order before production begins.
Pursuant to Art. 38 point 3 of the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended), the right to withdraw from a contract concluded off-premises or at a distance does not apply in the case of purchase a product configured based on the buyer's individual order.
The products offered by the Seller are only sample motifs. The buyer does not receive the original painting, but only a copy consistent with the selected motif, prepared according to the selected technique on the selected material.
Complaints are considered on the basis of a letter specifying the reasons for the complaint. The product is inspected on the basis of the goods delivered to the company's headquarters together with the original packaging.
Personal data, copyright:
Placing an order in the online store is tantamount to the buyer's consent to the use and storage of personal data provided in the order form in accordance with the applicable provisions of the Personal Data Protection Act (Journal of Laws No. 133, item 883 (to the extent necessary to complete the order). The Buyer has the right to view and correct his/her personal data, and may also request to be removed from the customer list. The Seller undertakes not to share any personal data of his/her customers, both address data and e-mail addresses, for purposes unrelated to the execution of orders.
Prints offered in the store are subject to copyright. Buyers or third parties are not authorized to produce, distribute or reproduce the products.
The purchase of products does not constitute the acquisition of any copyright or other intellectual property rights to the purchased products.
By placing an order and providing his photo/graphic, the customer declares that he has all rights, including copyrights to the submitted materials.
Final Provisions:
In matters not regulated in these Regulations, generally applicable provisions of law shall apply.
HOMEprint reserves the right to change the Regulations, which are effective from the date of their publication on the store's website.
